The applicants, Pintu Bhagat and another, sought regular bail before the Gujarat High Court after being arrested on 05.07.2026 in connection with an FIR registered at Dungra Police Station, Valsad, for alleged offences including possession of 12.259 kg of Ganja (an intermediate quantity) and arms-related charges. The defence argued the applicants were falsely implicated and that nothing remained to be recovered, while the State opposed bail citing the gravity of the offences. The Court noted that the quantity of Ganja fell in the 'intermediate' category, making the stringent conditions of Section 37 of the NDPS Act inapplicable, and that prolonged pre-trial detention would amount to pre-trial conviction. Applying the principle that 'bail is the rule and jail is the exception' and the right to personal liberty under Article 21 of the Constitution, the Court allowed the bail application subject to conditions including a personal bond of Rs. 25,000 each with one surety, surrender of passport, not leaving Gujarat without permission, and not tampering with evidence.
