Pareshkumar Kurjibhai Patel filed a successive regular bail application before the Gujarat High Court under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in connection with an FIR registered at Kuvadwa Road Police Station, Rajkot City, for offences under the Gujarat Prohibition Act and the Bharatiya Nyaya Sanhita, 2023, relating to possession and transportation of prohibited liquor concealed in camouflage packaging. The State opposed bail citing the gravity of the offence and the risk of the applicant fleeing justice. The Court considered that the investigation was complete, the chargesheet had been filed, the applicant had been in custody since 20 June 2026, nothing remained to be recovered, and a similarly situated co-accused had already been granted bail. Relying on the principle that 'bail is the rule and jail is the exception,' Article 21 of the Constitution of India, and precedents including Sanjay Chandra v. CBI and Gudikanti Narasimhulu v. Public Prosecutor, the Court granted regular bail subject to conditions including a personal bond of Rs. 25,000, restrictions on travel outside Gujarat, monthly presence before the police station for six months, and prohibition from entering Morbi, Rajkot, and Surendranagar districts for six months.
