The applicant, Munna @ Sagrambhai Gokalbhai Saniya, sought regular bail before the Gujarat High Court in connection with FIR No. 69 of 2017 registered at Drangadhra Taluka Police Station, Surendranagar, for offences including murder (Section 302 IPC), attempt to murder (Section 307 IPC), and other related charges. The defence argued that the investigation was complete, all co-accused in the related sessions cases had been acquitted after all witnesses turned hostile, a settlement had been reached between the parties, and prolonged detention amounted to pre-trial conviction. The State opposed bail citing the applicant's eight past antecedents, his arrest on a warrant, and alleged evidence tampering, while the original complainant filed an affidavit expressing no objection to bail. The Court, applying the principles from Sanjay Chandra v. CBI and Gudikanti Narasimhulu v. Public Prosecutor and the constitutional guarantee under Article 21, found that no circumstances justified continued detention and allowed the bail application with conditions including a personal bond of Rs. 25,000, monthly police station attendance, surrender of passport, and prohibition from entering Drangadhra Taluka for three months.
