The petitioner Mohammad Yunus Alennabi Pathan (husband) and his in-laws sought quashing of an FIR registered at Kim Police Station, Surat, in which the complainant-wife Madinaben alleged dowry demands of Rs. 10 lakh or transfer of a Vadodara house, physical assault, and threats by the husband and his family members under Sections 498A, 323, 504, 506(2), 114 IPC and Sections 3 & 4 of the Dowry Prohibition Act. The Gujarat High Court found that the FIR allegations against the family members were vague, omnibus, and lacked specific overt acts attributable to each accused, and that there were fundamental contradictions between the complainant's prior application dated 19-07-2016 and the FIR. The Court further noted geographical impossibilities in the complainant's account, a seven-month unexplained delay in lodging the FIR, and the fact that the in-laws resided separately at Godhra and Vadodara, making the allegations against them unfounded. Applying the principles laid down in Kahkashan Kausar v. State of Bihar and related precedents, the Court held that the proceedings amounted to an abuse of process initiated to wreak personal vengeance, and accordingly quashed the FIR.
