The applicants, who were frontline operational personnel engaged through third-party logistic/vendor entities, were accused of misappropriating goods worth Rs.1,46,45,919/- along with other accused. They filed an application to quash the FIR, arguing that the offence of breach of trust and cheating cannot coexist simultaneously and that the dispute is purely civil and contractual in nature. The court considered the submissions and referred to various decisions of the Apex Court. The investigation was still ongoing, and the chargesheet had not been filed. The applicants were enlarged on bail.
