Karshanbhai Rukhadbhai Gohil, a forest department employee, sought regular bail before the Gujarat High Court after being arrested on 19 May 2026 in connection with FIR C.R. No.03/2026 for allegedly abetting the illegal felling of 1,690 trees in the Rajasthali Beat, Palitana Range, Bhavnagar, causing a loss of Rs.3,57,945/-. He was charged under multiple provisions of the Indian Forest Act and the Wildlife (Protection) Act. The State opposed bail, arguing risk of tampering with evidence and likelihood of repeat offences. The Court, relying on the principles in Sanjay Chandra v. CBI and Gudikanti Narasimhulu v. Public Prosecutor, and the constitutional guarantee of personal liberty under Article 21, held that since the investigation was complete, the chargesheet filed, and trial before a JMFC would take time, prolonged detention would amount to pre-trial conviction. The Court granted regular bail on a personal bond of Rs.25,000/- with stringent conditions, most notably requiring the applicant to plant 850 forestry-species trees at his own expense within 15 days of release and maintain them for three years under Forest Department supervision.
