The applicant, Jivrajsinh Hanumatsinh Rajput, sought regular bail before the Gujarat High Court after being re-arrested for failing to appear before the trial court, which had led to the issuance of an arrest warrant and discharge of his sureties. He had previously been granted regular bail by a coordinate bench of the same court in February 2025 in connection with an FIR registered at Amirgadh Police Station, Banaskantha, for offences under the Prohibition Act and the Bharatiya Nyaya Sanhita, 2023. The State opposed the application citing the nature and gravity of the offences. The court, relying on the principle that 'bail is the rule and jail is the exception' and the constitutional guarantee of personal liberty under Article 21, and citing Supreme Court precedents in Sanjay Chandra v. CBI and Gudikanti Narasimhulu v. Public Prosecutor, held that prolonged pre-trial detention amounts to pre-trial conviction. The court allowed the application and granted regular bail subject to a personal bond of Rs. 25,000 with one local surety and several conditions including regular court attendance, monthly police station reporting for six months, and surrender of passport.
