The applicant (mother-in-law) sought quashing of FIR No. I-C.R.4/2018 registered against her under Sections 498A, 323, 494, 406, and 114 IPC, arising from matrimonial disputes between her son and the complainant, who had married in 2007 and lived in London. The Gujarat High Court found that the complainant's prior marriage had not been dissolved before her marriage to the accused, rendering that marriage void, which in turn barred the application of Section 498A IPC. The court further held that allegations of physical abuse were vague and non-specific, Section 406 IPC could not apply as no entrustment was alleged, Section 494 IPC failed since the complainant herself was married during a subsisting marriage, and Section 114 IPC could not stand as the substantive offences were not made out. The court also noted the well-recognised judicial concern about omnibus and exaggerated allegations against relatives of the husband in matrimonial complaints, citing several Supreme Court precedents urging caution in such cases. Accordingly, the FIR against the applicant (mother-in-law) was found unsustainable.
