Geetaben Rajubhai Patani sought regular bail before the Gujarat High Court in connection with FIR No. I-C.R. No. 13 of 2019, registered with CID Crime Ahmedabad Zone Police Station, for offences including criminal breach of trust, cheating, forgery, and criminal conspiracy under the Indian Penal Code. The allegation against her was that, as a nominee on her husband's insurance policy, she was involved in forging her husband's death certificate and other documents to fraudulently claim insurance proceeds within one and a half months of the policy being issued, though no actual benefit was ultimately derived. The State opposed bail citing the gravity of the offence, risk of absconding, and potential tampering with evidence, while the chargesheet was yet to be filed. The Court, applying established bail jurisprudence including the principle that 'bail is the rule and jail is the exception' and the right to personal liberty under Article 21 of the Constitution, and noting that the substantial part of investigation was over, co-accused had been granted bail, and the applicant had no prior antecedents, found this to be a fit case for bail. The application was accordingly allowed subject to conditions including a personal bond of Rs. 25,000, surrender of passport, restrictions on leaving Gujarat, and regular reporting to the police station.
