Daxesh Mahendrabhai Parmar filed a successive regular bail application before the Gujarat High Court under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, after being arrested on 04.05.2026 in connection with an FIR registered at Sayajiganj Police Station, Vadodara City, for offences of criminal breach of trust, cheating, abetment, criminal conspiracy, and violations under the Gujarat Protection of Interest of Depositors Act, 2003. The State opposed the application citing the nature and gravity of the offences. The Court considered several factors including that the chargesheet had already been filed, a co-accused had already been granted bail, no further recovery was required from the applicant, the offences were not punishable with life imprisonment or death, and that prolonged pre-trial detention amounts to pre-trial conviction. Relying on the Supreme Court decisions in Sanjay Chandra v. CBI and Gudikanti Narasimhulu v. Public Prosecutor, and the constitutional guarantee of personal liberty under Article 21, the Court held that bail is the rule and jail is the exception, and allowed the application.
