Dr. Ravinder Paul Singh Malik, a CPF Scheme employee of the Agricultural Economics Research Centre (AERC) under the University of Delhi since 1977, sought voluntary retirement in May 2010 while on Extraordinary Leave, which was denied by the University relying on an uncirculated 1985 Ministry of Education letter. His services were subsequently terminated retrospectively from 01.05.2009 via letters dated 30.01.2012 and 01.02.2012, citing unauthorised absence, without any disciplinary proceedings, hearing, or notice. The Delhi High Court found that no statute or UGC/MHRD guideline barred CPF Scheme employees from voluntary retirement, that the 1985 letter had no binding force, and that Fundamental Rule 56(k) applied to the petitioner. The Court further held that the termination was unsustainable as it violated natural justice and Article 14 of the Constitution, was effected retrospectively during a sanctioned leave period, and the Governing Body lacked the power to terminate academic staff under Ordinance XX-G. The petitioner was held entitled to voluntary retirement along with retiral benefits including provident fund and gratuity.
