The respondent obtained a decree of Rs. 10,65,965 with 9% interest against the petitioner for unpaid rent (April–August 2015) on a Gurgaon office premises. The petitioner challenged the execution of the decree by raising objections under Section 47 and Section 151 CPC, arguing that the suit was barred by Section 8 of the Societies Registration Act, was time-barred under Article 52 of the Limitation Act 1963, and that the decree was obtained by fraud. The Delhi High Court held that the scope of Section 47 CPC is limited to examining jurisdictional infirmity or voidness of a decree, and that an erroneous decree cannot be assailed in execution proceedings. All three objections raised by the petitioner were found to be devoid of merit, and the Executing Court's dismissal of the objections on 03.08.2022 was upheld.
