This Regular First Appeal under Section 96 of the Code of Civil Procedure, 1908 was filed by the legal heirs of Late Sh. Dhiraj Lal (Defendants) against a judgment and decree dated 17.12.2024 passed by the trial court, which decreed the suit filed by the legal heirs of Late Sh. Rup Chand and Smt. Padma Wati (Plaintiffs) for recovery of possession, permanent injunction, and damages/mesne profits in respect of property at T-38/1, Kalu Sarai, Hauz Khas, New Delhi. The Plaintiffs claimed to be the absolute owners of the suit property, having purchased it via a registered Sale Deed dated 28.01.1971, and alleged that the Defendants (real brothers of Plaintiff No. 1) were allowed to reside there as licensees out of love and affection, but refused to vacate despite repeated requests. The Defendants contested the suit, claiming the property was purchased from funds belonging to all legal heirs of their deceased father Late Sh. Sarju Ram, that they were co-owners, and alternatively that they had acquired title by adverse possession after over 42 years of continuous possession. The trial court decreed the suit in favour of the Plaintiffs, and the Defendants' legal heirs have challenged that decree before the Delhi High Court in this appeal.
