The Delhi Transport Corporation (DTC) filed a writ petition under Article 226 of the Constitution challenging an Award dated 02nd February, 2005 passed by the Industrial Tribunal-III, Karkardooma, which directed regularisation of workman Shamsher Singh with effect from his initial date of appointment on 02nd March, 1982, along with all consequential service benefits. Shamsher Singh had originally been appointed as a Retainer Crew Driver on daily wages in 1982, was dismissed in 1983 following a fatal accident, and was subsequently reinstated with continuity of service and 50% back wages by an earlier Award in 1999, which DTC's challenge to had already been dismissed by the High Court. The Tribunal in the impugned Award found that DTC had discriminated against the workman by not regularising him from his initial appointment date while his juniors had been so regularised, and accordingly directed regularisation from 02nd March, 1982. DTC contended that the earlier Award only granted reinstatement and continuity of service, not regularisation, and that regularisation under the applicable service conditions was subject to merit, seniority, conduct, performance, and availability of vacancies. The High Court reserved judgment on 20th April, 2026, with the matter concerning whether the Tribunal's direction of retrospective regularisation was legally sustainable.
