Multiple writ petitions were filed before the Chhattisgarh High Court by candidates who qualified a teacher recruitment examination held on 10.06.2023 but were not called for counselling. The petitioners challenged an advertisement dated 04.05.2023 issued by CGVYAPAM for 12,489 teacher posts, which allocated 62–68% vacancies to Scheduled Tribes, on the ground that the underlying reservation notification dated 29.11.2012 and the district/division-wise model rosters had already been declared unconstitutional by a Division Bench on 19.09.2022. The court held that the advertisement impermissibly relied on the quashed notification and unconstitutional rosters, that a pending SLP before the Supreme Court does not restore the efficacy of a quashed notification absent a stay, and that reservation exceeding 50% violates the binding constitutional ceiling affirmed in Indra Sawhney and subsequent judgments. The court quashed the advertisement to the extent it incorporated the unconstitutional reservation arrangement, but declined to order wholesale cancellation of appointments already made, directing that all future appointments and promotions must conform to a valid reservation framework.
