The petitioner, Ratna Kashyap, filed a petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 before the Chhattisgarh High Court seeking to quash an FIR, charge sheet, cognizance order, charge-framing order, and all criminal proceedings arising from Crime No. 1061/2025, which alleged stalking and molestation under Section 78(1)(i) of the Bharatiya Nyaya Sanhita, 2023 and Section 12 of the POCSO Act. The petitioner contended that the complaint was a false counterblast filed after a compromise was reached in an earlier, more serious case (Crime No. 674/2025 involving rape and POCSO offences), and that the allegations did not make out the essential ingredients of the offences. The State opposed quashing, arguing that the FIR had been duly investigated, a charge sheet filed, cognizance taken, and charges framed, and that the inherent jurisdiction under Section 528 BNSS must be exercised sparingly. The High Court, relying on State of Haryana v. Bhajan Lal, M/s Neeharika Infrastructure Pvt. Ltd. v. State of Maharashtra, and Amit Kapoor v. Ramesh Chander, held that the allegations of stalking and gestures could not be brushed aside as inherently absurd at this stage, and that questions of sexual intent under Section 11 of the POCSO Act are matters of fact to be determined by the Trial Court on evidence. The petition was accordingly not allowed at this stage.
