Multiple writ petitions were filed before the Chhattisgarh High Court challenging an advertisement dated 04.05.2023 issued by CGVYAPAM for recruitment of approximately 12,057 teacher posts, which reserved between 56.62% and 68.42% of vacancies for Scheduled Tribes, relying on a reservation notification dated 29.11.2012 and district/division-wise model rosters. The Division Bench had already declared that notification and those rosters unconstitutional on 19.09.2022 in WPC No. 591/2012, and the petitioners argued the State could not revive a quashed legal instrument through a fresh advertisement. The State contended that a Supreme Court order dated 01.05.2023 in SLP(C) Nos. 18816-18817/2022, which permitted recruitment to proceed, protected the entire process; however, the High Court held that this order was conditional ('subject to final outcome') and did not validate the quashed reservation arrangement. Drawing on the constitutional jurisprudence from Indra Sawhney, M.R. Balaji, R.K. Sabharwal, and Dr. Jaishri Laxmanrao Patil, the Court held that the 50% ceiling on reservations is binding, that a quashed notification cannot serve as the foundation for executive action, and that backlog vacancies traced to unconstitutional rosters cannot independently justify excess reservation; the Court declined wholesale cancellation of appointments already made but held the impugned advertisement and recruitment process based on the unconstitutional reservation framework unsustainable.
