Multiple writ petitions were filed by candidates challenging a recruitment advertisement dated 04.05.2023 issued by CGVYAPAM for 12,489 teacher and assistant teacher posts, which allocated 62–68% of vacancies to Scheduled Tribes based on a reservation notification dated 29.11.2012 and district/division-wise model rosters. That notification and those rosters had already been declared unconstitutional by a Division Bench of the Chhattisgarh High Court on 19.09.2022, and no stay of that judgment was in operation. The court held that quashing a notification renders it non-existent in law, unlike a mere stay, and that the State could not indirectly revive the quashed reservation arrangement through a fresh advertisement; backlog vacancies traced to an unconstitutional roster could not independently validate reservation exceeding the 50% ceiling affirmed in Indra Sawhney and subsequent Supreme Court decisions. The Supreme Court's conditional order dated 01.05.2023 permitting the State to proceed with recruitment 'subject to outcome' of pending SLPs did not immunise the advertisement from High Court scrutiny under Article 226 or validate the unconstitutional reservation. Accordingly, the advertisement dated 04.05.2023 was quashed to the extent it incorporated the unconstitutional reservation arrangement, though no wholesale cancellation of appointments already made was directed, and all future appointments/promotions were required to contain a stipulation that they would be subject to the final outcome of the Supreme Court proceedings.
