The petitioners, the husband (Jakir Hossain) and brother-in-law (Jahir Abbash) of the complainant, sought quashing of criminal proceedings initiated against them under Sections 498A, 323, 325, 308, and 494 IPC read with Sections 3 and 4 of the Dowry Prohibition Act, 1961, arising from a complaint alleging dowry-related cruelty, physical assault, and a second marriage by the husband. The Calcutta High Court found that the allegations in the complaint were general and omnibus in nature, lacking specific details of time, date, place, or manner of the alleged offences. Relying on the Supreme Court's decision in Dara Lakshmi Narayana & Ors. vs State of Telangana & Anr. (2024) and other precedents, the Court held that vague and sweeping allegations in matrimonial disputes, without concrete particulars, constitute an abuse of the process of law. Accordingly, the Court allowed the criminal revision and quashed the proceedings pending before the Additional Chief Judicial Magistrate, Malda, Chanchal.
