The dispute arose from a Title Suit filed in 2002 by Smt. Geeta Khemka and her late husband against the Southern Avenue Rajeshwari Residents Welfare Association, seeking declaration that a special general meeting held on 9 July 2000 was null and void and challenging the functioning of the managing committee. During the suit, the Trial Court struck off the defence of the Association under Order 11 Rule 21 CPC on 3 December 2009 for non-compliance with a court order to produce documents, and subsequently proceeded ex-parte against the Association. Two revision petitions came before the Calcutta High Court: CO 3434 of 2011 (by the plaintiffs, challenging the Trial Court's order allowing the Association to seek production of documents despite its defence being struck off) and CO 1032 of 2012 (by the Association, challenging the Trial Court's refusal to recall the order striking off its defence).
