The petitioners — a husband (Arindam Ghosh), his mother (Tapashi Ghosh), and his sister (Aditi Ghosh) — filed a criminal revision before the Calcutta High Court seeking to quash proceedings initiated against them under Sections 498A, 323, 354D, 506, and 34 of the IPC, arising from a complaint filed by the wife (de facto complainant) in May 2024, approximately three years after she had left the matrimonial home in February 2021. The wife alleged mental and physical torture for dowry since the marriage. The Calcutta High Court, relying on the Supreme Court's ruling in Dara Lakshmi Narayana & Ors. vs State of Telangana & Anr. (2024) and other precedents, found that the allegations in the complaint and case diary were general and omnibus in nature, lacking specific instances, dates, or details of the alleged offences. The Court observed that permitting the case to continue would amount to an abuse of the process of law, as none of the essential ingredients of the alleged offences were made out against the petitioners. Accordingly, the High Court allowed the revision and quashed the criminal proceedings against all three petitioners.
