This case before the Bombay High Court concerned a Testamentary Suit filed by Dr. Govindaraja Venkatesh Iyengar, the named executor, seeking Probate of the last Will and Testament dated 22 December 1998 of Rajalakshmi Gopal Ayengar, wife of the eminent BARC scientist Dr. A.R.Gopal-Ayengar. The defendant, A.R.Sampathkumar (nephew of Dr. Gopal-Ayengar), who was in occupation of the subject bungalow at Mysore Colony, Chembur, Mumbai, contested the Will on grounds that the Testatrix was of unsound mind on the date of execution, that the Will was forged and fabricated, and that there was inordinate delay in filing the Probate Petition. Based on the evidence, including the testimony of the attesting witness and a handwriting expert whose evidence went largely unchallenged, and noting that the defence evidence itself undermined the defendants' case, the court found against the defendants on the question of unsound mind and in favour of the plaintiff on due execution of the Will.
