The petitioner, sister of detenu Devarakonda Sudheer @ Ajay Reddy, challenged a preventive detention order dated 16.04.2026 passed under the Andhra Pradesh Prevention of Dangerous Activities (PD) Act, which branded the detenu a 'Goonda' primarily on the basis of an NDPS Act offence involving seizure of 24.97 kg of ganja. The court found that the statutory definition of 'Goonda' under Section 2(g) of the PD Act is confined to offences under specific IPC chapters and does not cover NDPS Act offences, which fall under a separate 'drug offender' category. The court further held that the detaining authority had relied on irrelevant material, including a previously quashed detention order and stale antecedents, thereby vitiating the subjective satisfaction required for a valid detention order. Additionally, the court noted that the detention order was passed while the detenu was already in judicial custody without disclosing compelling necessity for preventive detention. The writ petition was accordingly allowed and the detention order was quashed.
