Sabena Prakash, wife of detenu Dr. Ravi Prakash, filed a habeas corpus petition before the Andhra Pradesh High Court challenging the legality of her husband's arrest by AP Police in Bengaluru on 30.08.2026 and his subsequent remand, arguing that no transit remand was obtained from a Karnataka Magistrate before he was transported to Mydukur, YSR Kadapa. The court examined Article 22(2) of the Constitution and relevant provisions of the CrPC and BNSS 2023, distinguishing cases such as Priya Indoria and Gautam Navlakha, and held that transit remand is mandatory only when the journey to the jurisdictional Magistrate would exceed 24 hours. Since the detenu was admittedly produced before the jurisdictional Magistrate at Mydukur within 24 hours of arrest (travel time excluded), and grounds of arrest were communicated to him and his family, no violation of Article 22(2) was made out. The court further held that a writ of habeas corpus does not lie against a valid judicial remand order passed by a Magistrate with jurisdiction, and dismissed the petition.
