The appellants (husband and sons of the deceased, Putta Adilakshmi) challenged the dismissal of their motor accident compensation claim by the Motor Accidents Claims Tribunal, Amalapuram. The deceased had sustained injuries after falling from an APSRTC bus on 11.02.2008 when the driver allegedly moved the bus rashly while she was alighting, and she subsequently died on 18.03.2008. The MACT dismissed the claim primarily on the ground of delay in lodging the FIR (filed seven days after the accident) and doubted the genuineness of the accident. The High Court of Andhra Pradesh, relying on Supreme Court precedent (Ravi v. Badrinarayan, (2011) 4 SCC 693), held that delay in lodging an FIR cannot by itself be a ground to reject a compensation claim, as attending to the victim's treatment takes priority over reporting to police. The court proceeded to examine whether the claimants were entitled to compensation and on what quantum, indicating interference with the MACT's dismissal was warranted.
