The dispute arose from a suit for specific performance filed by the Plaintiff (Mediga Anjaiah) based on an Agreement of Sale dated 03.10.2009, under which he claimed to have paid Rs.1,50,00,000/- to the Defendants (Perivemula Venkateswarlu and another) and to have been handed possession of 2.19 cents of schedule property. The Trial Court (VI Additional District Judge, Prakasam at Markapur) granted two temporary injunctions: one restraining the Defendants from interfering with the Plaintiff's possession and another restraining them from alienating the property till disposal of the suit. The Defendants challenged both orders before the Andhra Pradesh High Court, contending that the agreement was forged and fabricated using blank stamp papers obtained as security for a loan of Rs.3,00,000/-, that the Plaintiff lacked financial capacity to pay Rs.1.50 crores, and that the Trial Court failed to record proper prima facie findings. The Defendants' counsel also gave an undertaking before the High Court that the Defendants would not alienate the property without the Court's permission. The judgment text as provided does not record the final order of the High Court on the appeals.
