The decree holder (P. Obulesu) filed an Execution Petition (EP 75/2014) seeking civil arrest of the judgment debtor (B. Nandi Reddy) under Order XXI Rules 37-38 CPC after a money decree was passed in OS 12/2011. The trial court dismissed the EP citing discrepancies in the revenue extract (Ex.X-1), absence of VRO signatures on each page, no proof of possession, and a pending appeal (AS 16/2015). The AP High Court found this dismissal erroneous, holding that the decree holder need only establish prima facie evidence of the judgment debtor's means, after which the burden shifts to the judgment debtor to prove inability to pay under Section 51 CPC. The court further held that a pending appeal does not operate as an automatic stay of execution under Order XLI Rule 5(1) CPC, and relied on the rulings in Konda Subbaiah and Gouru Giridhara Rao in support. The High Court set aside the dismissal and directed fresh consideration of the execution petition in light of the evidence on record.
