The petitioner, Lakshmi Narayana Tripuramallu, challenged the rejection of his passport renewal application by the Regional Passport Officer, Vijayawada. The passport authority had refused renewal on the ground that a CBI criminal case (C.C.No.22/2018) was pending against him, even though the trial court had discharged him from that case on 03.02.2022. However, the CBI had filed a Criminal Revision Case (Crl.R.C.No.383/2022) challenging the discharge order, and a coordinate bench of the Andhra Pradesh High Court had granted interim suspension of the discharge order on 21.06.2022, effectively reviving the charges. The court examined Section 6(2)(f) of the Passports Act, 1967, which mandates refusal of a passport when criminal proceedings are pending before a court, and noted that the interim suspension of the discharge order meant that, for all practical and procedural purposes, the criminal proceedings against the petitioner stood revived.
