The petitioners, Gaguturu Shameer Alias Pamir and others, filed a criminal petition under Section 482 of the Code of Criminal Procedure, 1973, and Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, to quash the proceedings against them in a case registered under Sections 85 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023, and Sections 3 and 4 of the Dowry Prohibition Act, 1961. The court held that the petitioners are entitled to the benefit under Section 35(3) of the BNSS, as the alleged offences are punishable with imprisonment for less than seven years. The court directed the investigating officer to comply with Section 35(3) of the BNSS and to follow the directions issued in the cases of Satender Kumar Antil, Arnesh Kumar, and Md. Asfak Alam.
