Sri Durga Malleswara Swamy VarlaDevasthanam (a temple trust) filed a Writ Appeal (W.A. No. 440 of 2025) challenging a Single Judge's order dated 26.07.2022 that had allowed writ petitions filed by an employee (P. Sreenivasulu) seeking regularisation of services and extension of time scale. Along with the appeal, the temple filed I.A. No. 1 of 2025 seeking condonation of a massive delay of 892 days in filing the appeal. The respondent-employee opposed the application, pointing out that the court's orders had already been complied with by the Endowments Commissioner and the Executive Officer in January 2025, and that no sufficient cause was shown for the delay. The Division Bench, relying on Supreme Court precedents (Office of Chief Post Master General vs. Living Media India Ltd., State of M.P. vs. Bherulal, and University of Delhi vs. Union of India), examined whether the explanation offered — that the new Executive Officer came to know of the orders only on taking charge in January 2025 — constituted sufficient cause to condone such an inordinate delay. The court noted that government/public bodies cannot claim mechanical condonation of delay and must demonstrate bonafide effort and acceptable explanation.
