The appellants (Abburi Ramakrishna and others) filed a Writ Appeal before the Andhra Pradesh High Court at Amaravati challenging a Single Judge's order dated 24.02.2016, which had dismissed their writ petition assailing a Government Order (G.O.Ms.No.1875, dated 14.12.2006) that cancelled an earlier permission for alienation of endowment land in Survey No.31/4, Patamata Lanka, Vijayawada. The appellants had purchased the property from vendors whose title traced back to a cultivating tenant (Rangamma) who was found to have colluded with third parties to circumvent a five-year prohibition on alienation under Section 82 of the Endowments Act. The appeal was filed with a delay of 1,470 days, and the appellants sought condonation under Section 5 of the Limitation Act citing non-communication of the order, bifurcation of the High Court, misplacement of files, and elevation of their counsel as Judges. The Division Bench found the explanation vague, lacking bona fides, and demonstrating sheer negligence, noting unexplained gaps of nearly three years and more, and relying on settled Supreme Court precedents on limitation. Accordingly, the application for condonation of delay was dismissed, and consequently the Writ Appeal was also dismissed.
