U.P. Electronics Corporation Ltd. had floated a tender in February 2018 for DNA Unit instruments for the Forensic Science Laboratory, Varanasi, and awarded a work order to P.S. Global. After all 31 items were supplied, installed, and certified satisfactory, the appellant terminated the contract in June 2018 alleging cartel/fraud and confiscated the performance bank guarantee of Rs. 93,79,535. A Sole Arbitrator awarded Rs. 8,99,38,275 plus 8% interest in favour of P.S. Global, which was upheld by the Commercial Court under Section 34 of the Arbitration and Conciliation Act, 1996. The Allahabad High Court (Lucknow Bench), hearing the appeal under Section 37 of the Act, considered and rejected the appellant's challenges relating to alleged fraud, the bar under Section 69 of the Partnership Act for an unregistered firm, abatement of proceedings due to the death of a signing partner, non-joinder of the State of U.P. as a necessary party, and the alleged non-speaking nature of the Section 34 order, holding that the arbitral award and the Commercial Court's order were valid and did not warrant interference.
