The appellant, Subhash Chandra Tyagi, challenged his termination from service as an ad-hoc Assistant Teacher at Shastri Smarak Inter College, Baghpat, which was ordered after his earlier writ petition (Writ-A No.42763 of 1993) was dismissed as infructuous. His original appointment in 1992 was premised on a short-term vacancy allegedly created by one Mr. Harit going on leave without pay, but records revealed that Mr. Harit never received salary from the State exchequer and no documents establishing his leave were found. The D.I.O.S. who had approved the appellant's appointment was subsequently penalised by the State Government for facilitating 96 fraudulent appointments. The learned Single Judge dismissed the subsequent writ petition (Writ-A No.6090 of 2011) challenging the termination orders and imposed a cost of Rs.2,16,000/- on the appellant, calculated at Rs.1,000 per month for the years he had drawn salary. The present Special Appeal before a Division Bench of the Allahabad High Court arises from that dismissal, with the judgment text ending before the final decision of the Division Bench is recorded.
