This was a State government appeal (Government Appeal No. 562 of 1989) before the Allahabad High Court, Lucknow Bench, challenging the acquittal of accused persons by the IInd Additional Sessions Judge, Sultanpur, in connection with an incident on 21.06.1986 arising from a land dispute, in which Muhammad Yunus was allegedly killed and others injured by a group armed with axes and lathis. The trial court had acquitted all accused on grounds including delayed and anti-timed FIR, unascertained place of occurrence, improbable assembly of accused from different villages, material discrepancies in witness testimony, absence of independent witnesses, and uncertainty as to whether the named accused alone caused the injuries. The High Court, on perusal of the record, found that the medical evidence—particularly the colour of contusions, state of the deceased's stomach, presence of rigor mortis, and estimated time of death (30–32 hours before autopsy)—supported the trial court's view that the incident likely occurred in the intervening night of 20/21.10.1986, not the morning of 21.06.1986 as alleged. The Court further noted that prosecution witnesses were all relatives, no independent witnesses were examined, the motive was unsubstantiated by documentary evidence, and the presence of unidentified assailants made it impossible to firmly attribute the injuries solely to the named accused. The High Court accordingly found no perversity in the trial court's reasoning warranting interference with the acquittal.
