The case arose from an FIR dated 22.10.2025 filed by a Scheduled Caste victim alleging rape by Abhishek Maurya and pressure from his family members (the appellants) not to complain, with charges under the Bharatiya Nyaya Sanhita and the SC/ST (Prevention of Atrocities) Act. The victim's subsequent statement under Section 183 BNSS contradicted the FIR, indicating consent and self-harm, and a compromise was reached on 29.11.2025. The appellants, who are family members of the co-accused, challenged the summoning order dated 30.03.2026 and the charge-sheet dated 17.12.2025 passed by the Special Judge, SC/ST Act, Varanasi. The Allahabad High Court found that no specific intentional caste-based insult was alleged against the family-member appellants, that the dispute was essentially personal and matrimonial in nature, and that the essential ingredients of the SC/ST Act offences were absent, relying on precedents including Swaran Singh, Gorige Pentaiah, and Hitesh Verma. Accordingly, the court quashed the summoning order and charge-sheet against the appellant family members.
