The applicant, Mashu @ Aman Joshi, sought anticipatory bail before the Allahabad High Court in connection with Case Crime No. 20 of 2026, registered under Section 108 of the Bharatiya Nyaya Sanhita (BNS) at Police Station Chhatta, District Agra. The FIR alleged that the applicant established a physical relationship with the victim on a false promise of marriage, threatened her upon being confronted about his existing marriage, and subjected her to mental cruelty, after which the victim died by suicide on 31.01.2026. The applicant had previously failed to comply with a court direction to cooperate with the investigating officer, and proceedings under Section 82 Cr.P.C. (proclamation as an absconder) had been initiated against him on more than one occasion. Relying on Supreme Court precedents in Lavesh vs. State (NCT of Delhi), State of M.P. vs. Pradeep Sharma, Prem Shankar Prasad vs. State of Bihar, and Srikant Upadhyay vs. State of Bihar, the High Court held that a person declared a proclaimed offender or against whom Section 82 Cr.P.C. proceedings are pending is not entitled to the extraordinary relief of anticipatory bail, and accordingly dismissed the application.
