This criminal appeal was filed by Kailash Yadav and Sukhram Teli against their conviction by the Additional Sessions Judge, Basti, for an acid attack on Ramdayal on the intervening night of 2/3 November 1975. The prosecution alleged that Kailash threw acid from an earthen pot at the instigation of Sukhram, causing grievous burn injuries to the victim's face, eyes, neck, chest, and other parts of his body. Kailash Yadav died during the pendency of the appeal and proceedings against him abated; the sole surviving appellant Sukhram Teli argued that no overt act was attributed to him, that identification in torchlight was doubtful, and that prosecution evidence was weak and uncorroborated. The Allahabad High Court noted that the testimonies of the injured (PW-4), his father (PW-1), and his sister (PW-3) remained unrebutted in cross-examination, were corroborated by the medical evidence of acid burn injuries certified as grievous, and that the FIR was lodged without unreasonable delay.
