The appellant, Smt. Juli Begum, filed a criminal appeal before the Allahabad High Court challenging the order dated 16.11.2024 passed by the Special Judge (SC/ST Act), Jalaun, which framed charges against her under Sections 323, 354, 387, 504 and 506 IPC and Sections 3(1)(r) and 3(1)(s) of the SC/ST (Prevention of Atrocities) Act, 1989. The charges arose from a complaint by Smt. Mamta, a Scheduled Caste woman, who alleged that the appellant and co-accused demanded Rs.1,00,000/- from her, abused her with caste-related slurs, assaulted her, and outraged her modesty. The appellant contended that no specific role was assigned to her, the allegations were vague, and the incident occurred inside a house and not in public view, relying on the Supreme Court's ruling in Hitesh Verma v. State of Uttarakhand. The High Court found that specific prima facie allegations had been made against the appellant in the complaint and in statements recorded under Sections 200 and 202 Cr.P.C., corroborated by three independent witnesses, and that at the stage of framing of charges only a prima facie case need be established. The Court dismissed the appeal, holding that the impugned order framing charges was legally sustainable and that the appellant's defence could be adjudicated during trial.
